1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Ziad Jweiles ("Penbloom," "we," "us") governing your use of the Penbloom website and platform (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
2. What Penbloom is
Penbloom is a free platform that teaches people how to write a book, through self-paced lessons, interactive exercises, quizzes and course tests, a daily writing prompt with an optional public gallery, and related tools. We may add, change, or remove features at any time.
3. Eligibility and accounts
Penbloom is meant to be usable by writers of any age, but you must be at least 13 years old to create your own account. If you are younger than that, you can still use Penbloom, but only alongside a parent or guardian, using that adult's own account - our "Early Readers" courses are specifically designed to be worked through this way, together with a caregiver, rather than by a young child alone. See the "Children's Privacy" section of our Privacy Policy for more detail.
You're responsible for keeping your account credentials confidential and for all activity under your account. Usernames are meant to be pseudonyms - please don't use your real name or other identifying information as your username.
4. Content you submit
Anything you write into a lesson's writing space, a quiz, a course test, or a daily story submission remains yours. By submitting it, you grant Ziad Jweiles a non-exclusive, worldwide, royalty-free license to store, display, and process it as needed to operate the Service - for example, showing your own saved answers back to you, or, if you submit a story to the Daily Writing Challenge and it's approved, displaying it in the public gallery under your chosen username.
Public submissions go through moderation: a story is only shown publicly once approved, any submission can be reported, and a story that receives enough reports is automatically hidden pending review. Don't submit anything that:
- isn't yours to share, or infringes someone else's copyright or other rights;
- is hateful, harassing, sexually explicit, or otherwise inappropriate for a platform used by young people;
- contains someone else's personal information; or
- is illegal where you or we are located.
We may remove content, or suspend or terminate an account, that violates these Terms.
5. Acceptable use
You agree not to:
- use the Service for anything illegal, or to harass, bully, or endanger anyone, especially another young user;
- try to access another user's account or data;
- interfere with or disrupt the Service (for example, attempting to overload it or bypass security measures); or
- scrape, copy, or redistribute course content in bulk without our permission.
6. Our content
The courses, lessons, exercises, and other original material on Penbloom belong to Ziad Jweiles (or our licensors) and are provided for your personal, non-commercial use in learning to write. You may not republish, sell, or otherwise redistribute our course content without permission.
7. Third-party links and embedded content
Some lessons embed YouTube videos or otherwise link to third-party sites. We don't control, and aren't responsible for, the content, policies, or practices of those third parties.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or secure, or that any writing advice will produce a particular result (like getting published).
9. Limitation of liability
To the fullest extent permitted by law, Ziad Jweiles will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed USD 100. (A fixed nominal cap, since Penbloom is free and a percentage-of-what-you-paid clause would be meaningless here - worth confirming this figure with a lawyer rather than treating it as settled.)
10. Indemnification
You agree to defend and indemnify Ziad Jweiles against any claims arising from your misuse of the Service or violation of these Terms.
11. Termination
You may stop using the Service, or delete your account, at any time (see our privacy request form). We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.
12. Governing law
These Terms are governed by the laws of Guatemala, without regard to its conflict-of-law principles, and any dispute will be brought in the competent courts of Guatemala. (This doc doesn't add an arbitration clause, since that's a real policy choice - worth discussing with a lawyer if you'd rather route disputes through arbitration instead of court.)
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, let you know directly. Continuing to use the Service after a change means you accept the updated Terms.
